Session Tardiness/Sickness/Cancellation *Prompt arrival to your session is expected and appreciated. *Your session will begin at the scheduled session time. Please do not arrive early. These session require extensive setup and all of the time prior to your session will be used to do so. *Late arrival to your session may result in a shortened session time. Arriving 20 minutes or more late to your session may lead to a session reschedule, depending on photographer's schedule, and will require an additional reschedule fee ($150) to be paid prior to new session date. *If session needs to be rescheduled for any reason, you may do so via email at least 24 hours prior to session time. Your session will be rescheduled at no additional charge. We request a reschedule if child is showing symptoms of illness or running a fever 24 hours prior to session or anyone you have come in contact with prior to our session is running a fever or showing symptoms of illness. You will not be penalized for rescheduling due to illness of you or your child. *If your child arrives at session and appears sick or to be running a fever, photographer has the right to reschedule session. *Photographer also agrees to reschedule due to sickness and to alert client if others in photographer's household are sick. *Client and photographer have the right to cancel and reschedule due to death in the family with no penalty. *Client and photographer have the right to cancel and reschedule a session due to inclimate weather (snow or ice) with no penalty. *Photographer has the right to cancel and reschedule a session due to power outage in building.

Force Majeure *Neither party shall be liable for any costs or damages due to delay or nonperformance under this Agreement arising out of any cause or event beyond such Party’s control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, power or other mechanical failure, governmental action, or communication disruption. A Party claiming the benefit of this provision shall, as soon as reasonably practicable after or during the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance under this Agreement, as applicable, as soon as reasonably practicable.

Session Details *Only two adults and baby will be allowed in the studio for the session. Headcount will be limited as not to overwhelm the baby or crowd the shooting space. *At this time mask wearing is not required in Jackson County. Masks will not be required in studio, however if regulations change at the time of session client agrees to abide by Jackson County mandates. *Cake smash sessions should be scheduled when baby will be rested,fed and without illness for best results. It is the parent's responsibility to share this information when booking. *If at any point photographer suggests shooting session on an alternate day due to baby fussiness or non cooperation prior to starting smash portion and parent declines session will proceed as planned. Once smash begins session requirements of studio will considered to be met. A new session fee will be paid for a reshoot date. *An alternate smash can only be shot if reschedule fee is paid ($250) *In the case of above only new images from reshoot session will be provided in gallery. First session images will be deleted. *Cake smash sessions are for baby ONLY. No sibling/family setups will be included. *Session includes one portrait backdrop and one cake smash setup. *Cell phone use will not be permitted in shooting area.

Session Theme *Client will choose theme/and or colors *Studio will design and provide all smash set up decor. *Client may submit inspiration for smash, however studio will not copy another studio's set design.

Cake *All cakes will be white with buttercream frosting, minimal use of fondant. One layer only and will coordinate with chosen theme. Photographer and baker will determine cake design. *Our cakes are prepared by a third party. Items may contain or have come in contact with dairy, nuts, eggs and food dyes. Baker contact info will be provided by client request. *Client agrees that photographer is released from all responsibility for any injuries or allergic reactions from consumption of cake by any party. *Client agrees that photographer is released from all responsibility from any choking hazards caused by consumption of cake. *It is the responsibility of the client to inform the photographer of any known allergies upon booking. If client's child(ren) has known allergies client should supply cake and will receive $25 discount.

Spash *A splash can be added at no additional cost. The splash is complimentary and holds no monetary value. Should client decide to forgo the splash no discounts will be given. *Our studio adds Honest Organic Lavender bubbles by Target to the water. *If client prefers a different soap to be used during splash client may provide alternate product. *Studio is not responsible for any type of skin reaction/allergic reaction from use of bubbles during splash *Parent is responsible for making sure baby stays safe and seated while in tub. Studio is released from any injuries that may occur in splash tub.

Behavior Clause Photographer is not responsible for cooperation of child during the session. If child is uncooperative or does not participate during allotted time, no refunds and no re-shoots will be offered. Client agrees that they are solely responsible for the behavior of their child/ren during the entirety of their session. Photographer will capture as many images as possible, but does not guarantee a full gallery if child/ren are uncooperative or not behaving in a way desired by parents. This includes smiles and/or eye contact by child.

Retainer, Pricing and Ordering *A retainer fee of $250 is required to confirm your date and secure your spot. Dates are not secured until the retainer fee is received. RETAINER IS NONREFUNDABLE. *Client understands there will NOT be an online gallery of images sent. Gallery will be viewed with photographer either in person at the studio or via Zoom meeting. There are no exceptions to this policy. *Client understands they will choose thier final image selections at ordering appointment. *Photographer agrees to provide package price list to client via email prior to session date. *Client understands Missouri State Sales Tax will be charged on all packages and products. *Client understands all digital and print orders are non refundable. Orders cannot be canceled after 24 hours from ordering appointment. *Digital product will not be delivered until final payment is processed. *Once print orders are placed with photographer's lab all sales will be considered final. *Depending on product chosen, most orders will be delivered within 3 weeks from ordering appointment. This wait time may increase during the holiday season (November 1-December 31)

Model Release & Liability Client’s Right to Use Materials: Client is obtaining prints for personal use only and Client shall not sell said prints or authorize any reproductions of the prints by any third party unless such reproduction is authorized in writing by Photographer. If Client purchases limited, non-exclusive usage rights to digital files, such usage shall be for personal, non-commercial use only. Copyright Ownership: Anna-Marie Photography (the “Photographer”) owns all right and title to the copyrights in all images and photographic materials created on behalf of the Client and shall have the exclusive right to make prints or reproductions. Photographer reserves and the Client expressly grants the express right of Photographer to make reproductions and use the photographs and images of Client and/or Client's minor children listed above for use in connection with Photographer's portfolio, samples, self-promotions, affiliate organizations, entry in photographic contests or art exhibitions, advertising and promotion, books, magazines, illustrations, editorial use, or for display within or on the outside of the Photographer's studio, on Photographer's website, including on all printed materials, media on the Internet, and any current or future digital media. Nothing herein shall be deemed as a release, transfer, assignment or other disposal of Photographer’s rights in the materials. LIABILITY: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
