Session Tardiness/Sickness/Cancellation *Prompt arrival to your session is expected and appreciated. *Your session will begin at the scheduled session time. Please do not arrive early. Studio prep and cleaning will be done before your scheduled start time. *Late arrival to your session may result in a shortened session time. Arriving 20 minutes or more late to your session may lead to a session reschedule, depending on photographer's schedule, and will require an additional reschedule fee ($150) to be paid prior to new session date. *If session needs to be rescheduled for any reason, you may do so via email at least 24 hours prior to session time. Your session will be rescheduled at no additional charge. We request a reschedule if child is showing symptoms of illness or running a fever 24 hours prior to session or anyone you have come in contact with prior to our session is running a fever or showing symptoms of illness. You will not be penalized for rescheduling due to illness of you or your child. *If your child arrives at session and appears sick or to be running a fever, photographer has the right to reschedule session. *Photographer also agrees to reschedule due to sickness and to alert client if others in photographer's household are sick. *Client and photographer have the right to cancel and reschedule due to death in the family with no penalty. *Client and photographer have the right to cancel and reschedule a session due to inclimate weather (snow or ice) with no penalty. *Photographer has the right to cancel and reschedule a session due to power outage in building.

*Neither party shall be liable for any costs or damages due to delay or nonperformance under this Agreement arising out of any cause or event beyond such Party’s control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, power or other mechanical failure, governmental action, or communication disruption. A Party claiming the benefit of this provision shall, as soon as reasonably practicable after or during the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance under this Agreement, as applicable, as soon as reasonably practicable.

*Only two adults and the children being photographed will be allowed in the studio for the session. Headcount will be limited as not to overwhelm the baby or crowd the shooting space. *At this time mask wearing is not required in Jackson County. Masks will not be required in studio, however if regulations change at the time of session client agrees to abide by Jackson County mandates. *Portrait sessions should be scheduled when children will be rested,fed and without illness for best results. It is the parent's responsibility to share this information when booking. *If at any point photographer suggests shooting session on an alternate day due to baby fussiness, mood/cooperation of older children and parent declines session will proceed as planned. Once client declines reschedule session requirements of studio will considered to be met. A new session fee will be paid for a reshoot date. *Session can include UP to 1-4 portrait backdrops. If baby/child/children become fussy/uncooperative before the session has concluded client understands maximum drop number is not required for session to be considered completed. No reshoot will be offered if only 1-2 drops have been shot. *Cell phone use will not be permitted in shooting area.

Photographer is not responsible for cooperation of child during the session. If child is uncooperative or does not participate during allotted time, no refunds and no re-shoots will be offered. Client agrees that they are solely responsible for the behavior of their children during the entirety of their session. Photographer will capture as many images as possible, but does not guarantee a full gallery if child/children are uncooperative or not behaving in a way desired by parents. This includes smiles and/or eye contact by child.

Retainer, Pricing and Ordering of Product *A retainer fee of $190 is required to confirm your date and secure your spot. Dates are not secured until the creative fee is received. Retainer fee IS NONREFUNDABLE. *Retainer will be applied to purchase of Classic Package/minimum purchase requirement. *Purchase of Classic package is required and includes 10 fully edited digital images. *Client agrees Collection pricing was given in email prior to booking. *Client will receive pricing agreed upon at time of booking, regardless of price changes. *Client understands they will return to studio for viewing of images. Online gallery will NOT be available. *Client understands that they will make final choices for ordering at the viewing. Viewing will be scheduled at a time that is most convenient for all decision makers to attend. Payment will be collected for upgrades or products should client choose to order. *Client understands Missouri State Sales Tax will be charged on all packages that include tangible product. *Client understands all product orders are non refundable. If client chooses to cancel an order beyond the minimum purchase requirement of the Classic Collection, they have 72 hours to do so. Once that time has passed product orders will be considered final and sent to lab. Once photographer has sent order to lab, order is final. No changes may be made and no refunds will be given under any circumstance. *Digital product will not be delivered until final payment is processed. *Once digital product is shared via Dropbox with client, digital images will be considered delivered. There will be no returns or refunds granted once digital images have been made available for download *Depending on product chosen, most orders will be delivered within 3-4 weeks from ordering appointment. This wait time may increase during the holiday season (November 1-December 31). *If client orders prints or products but neglects to approve proofs the turnaround time will change. In that case orders will be returned 3-4 weeks FROM THE DATE CLIENT gives approval. *If client waits longer than one week for proof approval, client understands their print order will be moved to bottom of the queue. Other client's orders will not be delayed due to extended proofing times.

Client’s Right to Use Materials: Client is obtaining prints for personal use only and Client shall not sell said prints or authorize any reproductions of the prints by any third party unless such reproduction is authorized in writing by Photographer. If Client purchases limited, non-exclusive usage rights to digital files, such usage shall be for personal, non-commercial use only. Copyright Ownership: Anna-Marie Photography (the “Photographer”) owns all right and title to the copyrights in all images and photographic materials created on behalf of the Client and shall have the exclusive right to make prints or reproductions. Photographer reserves and the Client expressly grants the express right of Photographer to make reproductions and use the photographs and images of Client and/or Client's minor children listed above for use in connection with Photographer's portfolio, samples, self-promotions, affiliate organizations, entry in photographic contests or art exhibitions, advertising and promotion, books, magazines, illustrations, editorial use, or for display within or on the outside of the Photographer's studio, on Photographer's website, including on all printed materials, media on the Internet, and any current or future digital media. Nothing herein shall be deemed as a release, transfer, assignment or other disposal of Photographer’s rights in the materials. LIABILITY: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
