*Prompt arrival to your session is expected and appreciated. *Your session will begin at the scheduled session time. Please arrive early if you plan to get dressed at the studio, change diapers, give children snacks etc. *Late arrival to your session will result in a shortened session time. There is no exception to this rule. If you arrive late you will only be able shoot during your remaining session time. You will not be able to reshoot or reschedule. These sessions are sold out with a waiting list. There will be NO REFUNDS provided.

*Neither party shall be liable for any costs or damages due to delay or nonperformance under this Agreement arising out of any cause or event beyond such Party’s control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, power or other mechanical failure, governmental action, or communication disruption. A Party claiming the benefit of this provision shall, as soon as reasonably practicable after or during the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance under this Agreement, as applicable, as soon as reasonably practicable.

*Only two adults and the children being photographed will be allowed in the studio for the session. Headcount will be limited as not to overwhelm the kids or crowd the shooting space. *There will be no outfit changes during this session. *Cell phone use will not be permitted in shooting area. *Please remove chipped nail polish, temporary tattoos or marker from your child's hands and arms. These edits are viewed as self care and will not be included in your package. All self care edits (anything that couldn't have been taken care of at home) will be an additional cost and priced at a case by case basis. *If your child has allergies or food restrictions please bring along a replacement that would be safe for your child to consume.

Photographer is not responsible for cooperation of child during the session. If child is uncooperative or does not participate during allotted time, no refunds and no re-shoots will be offered. Client agrees that they are solely responsible for the behavior of their children during the entirety of their session. Photographer will capture as many images as possible, but does not guarantee a full gallery if child/children are uncooperative or not behaving in a way desired by parents. This includes smiles and/or eye contact by child. *Children will be photographed on a full sized air mattress that is elevated from the floor. If your child jumps on the bed or jumps off of the bed photographer is not liable for injuries. Photographer will take all measures to keep children safe, however, if child is behaving in an unsafe way parents must step in and correct behavior to avoid injuries.

*These sessions are prepaid and include 6 digital images delivered via digital download. *Clients may choose to upgrade package at the time of gallery viewing for an additional cost. *The prepaid amouont of $199 serves as a retainer fee and is considered non refundable. *Upgrades on digital product will not be delivered until final payment is processed. *Images will be returned by 12/1. A rush order of 48 hour image delivery can be requested for a $100 service fee. Otherwise, images will be returned by promised date in listing. No exception to this rule. *Client understands that online galleries will NOT be offered under any circumstance. Clients will view gallery via zoom.

Client’s Right to Use Materials: Client is obtaining prints for personal use only and Client shall not sell said prints or authorize any reproductions of the prints by any third party unless such reproduction is authorized in writing by Photographer. If Client purchases limited, non-exclusive usage rights to digital files, such usage shall be for personal, non-commercial use only. Copyright Ownership: Anna-Marie Photography (the “Photographer”) owns all right and title to the copyrights in all images and photographic materials created on behalf of the Client and shall have the exclusive right to make prints or reproductions. Photographer reserves and the Client expressly grants the express right of Photographer to make reproductions and use the photographs and images of Client and/or Client's minor children listed above for use in connection with Photographer's portfolio, samples, self-promotions, affiliate organizations, entry in photographic contests or art exhibitions, advertising and promotion, books, magazines, illustrations, editorial use, or for display within or on the outside of the Photographer's studio, on Photographer's website, including on all printed materials, media on the Internet, and any current or future digital media. Nothing herein shall be deemed as a release, transfer, assignment or other disposal of Photographer’s rights in the materials. LIABILITY: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
